SUBJECT: NOTICE OF PUBLIC HEARING – REGULATION 1: GENERAL PROVISIONS; REGULATION 2: PERMITS, RULE 1: GENERAL REQUIREMENTS; AND
RULE 3: FEES
 

On Wednesday, November 15, 2000, the Board of Directors of the Bay Area Air Quality Management District will hold a public hearing to consider amendments to District Regulation 1: General Provisions; Regulation 2: Permits, Rule 1: General Requirements; and Regulation 3: Fees. The Board will also consider approval of a Notice of Exemption from the California Environmental Quality Act. The hearing will be held in the 7th floor Board Room at the District Office, located at 939 Ellis Street, San Francisco. District Board meetings commence at 9:30 am.

The proposed amendments address comments made by affected industry members at the May 17, 2000 Board of Directors Meeting, at which other Regulation 1 and 2 changes were discussed and adopted. The current proposed amendments will:

  • Revise the requirement that certain monitors be calibrated and maintained in accordance with manufacturers specifications to allow operators to develop adequate alternative calibration and maintenance procedures.
  • Clarify what types of process and equipment changes are to be considered "alterations" for purposes of New Source Review.
  • Revise the definition of "modification" to allow continued use of legitimate existing grandfathered capacity for sources that were built before the District started permitting new sources in 1979.
  • Revise the initial reporting requirements for air emission monitor breakdowns.
  • Miscellaneous language clarifications to improve rule compliance and enforcement.
  • Clarify the fee requirements for alterations and modifications of permitted sources.

The District has determined, after a review of the record before it, that these proposed amendments to Regulation 1, Regulation 2, Rule 1, and Regulation 3 are exempt from provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) pursuant to State CEQA Guidelines, Section 15061, subd. (b)(3). The proposed amendments are administrative in nature, and do not in themselves affect air emissions from any sources or operations subject to the rule. It can therefore be seen with certainty that there is no possibility that these proposed amendments will have a significant environmental impact. The District intends to file a Notice of Exemption pursuant to State CEQA Guidelines, Section 15062.

A copy of proposed changes to Regulation 1 and to Regulation 2, Rule 1, and Regulation 3 with additions underlined and deletions stricken through, and a copy of the draft staff report is available for viewing on the District’s web site at www.baaqmd.gov, or by request.
