SUBJECT: PUBLIC HEARING - PROPOSED AMENDMENTS TO REGULATION 8, RULE 5: STORAGE OF ORGANIC LIQUIDS  

On Wednesday, December 15, 1999, the Board of Directors of the Bay Area Air Quality Management District will conduct a public hearing to consider amendments to Regulation 8, Rule 5: Storage of Organic Liquids. The hearing will be held in the 7th floor Board Room at the District Office, located at 939 Ellis Street, San Francisco. The Board meeting will commence at 9:30 a.m.

Amendments to Regulation 8, Rule 5 are being proposed in order to achieve emission reductions required as part of the Final San Francisco Bay Area Ozone Attainment Plan (OAP) adopted June, 1999. The proposed amendments to Regulation 8, Rule 5 are derived from Control Measure SS-07 of the OAP.

Attached to this notice is a copy of the proposed rule. New language is underlined, and language to be deleted is lined through. The proposed amendments to Regulation 8, Rule 5 are:

  • Effective June 1, 2000, slotted guidepoles on organic liquid storage tanks must be equipped with gaskets, wipers and pole sleeves to minimize evaporative emissions.
  • Operators seeking an exemption from the rule to take tanks out of service for preventative maintenance will be required to provide written certification of tank compliance and to minimize emissions during the exemption period.
  • The minimum required extension below the liquid surface for metallic shoe type seals in internal floating roof tanks will be changed.
  • Definitions will be added for gauge floats, guidepoles and zero gap pole wiper seals.

Pursuant to the California Environmental Quality Act, the District has conducted an initial study for the proposed amendments to Regulation 8, Rule 5 and has concluded that they would not have significant environmental impacts. Notice is hereby given that the District intends to adopt a negative declaration (Public Resources Code Section 21080 and CEQA Guidelines Section 15070) for the amendments. Written comments on the proposed negative declaration should be addressed to Ellen Garvey, Executive Officer/Air Pollution Control Officer, Bay Area Air Quality Management District, 939 Ellis Street, San Francisco, 94109, and must be received by 5:00 p.m. on Friday, December 3, 1999.

The proposed regulation may be viewed on the District's website at www.baaqmd.gov. Copies of the staff report and CEQA Initial Study are available on request from the District office.
