Regulation 5: Open Burning - Under Development

The Air District is developing amendments to Regulation 5 to exempt public agencies from paying Open Burning Fees when conducting prescribed burns for the purpose of wildfire prevention. This effort is part of the Air District's comprehensive Wildfire Air Quality Response Program, which is intended to prepare, prevent, and respond to future wildfires.

On September 23, 2019, the Air District will release a Notice of Public Hearing. The Air District will accept comments on the proposed rule amendments, staff report, and CEQA document through October 23, 2019.

At a public hearing on November 6, 2019, staff will present the final proposed documents for amendments to Regulation 5 and CEQA analysis to the Air District Board of Directors for consideration.

The Air District released draft amendments to Regulation 5 and a workshop report. Comments on those materials were accepted through August 12, 2019.

On July 24, 2019, the Air District will host a public workshop on proposed amendments to Regulation 5 (Open Burning) and Rule 6-3 (Wood-Burning Devices) as part of the Wildfire Air Quality Response Program. For details on the workshop, see the Events section of this page.
