AB 617 Expedited BARCT Implementation Schedule (Adopted December 19, 2018)

Learn about the Air District's process for adopting an Expedited BARCT Implementation Schedule, mandated by Assembly Bill 617 for industrial Cap-and-Trade facilities that do not currently have Best Available Retrofit Control Technology in place.

The AB 617 Expedited Best Available Retrofit Control Technology (BARCT) Implementation Schedule for Industrial Cap-and-Trade Facilities was adopted by the Air District's Board of Directors at a public hearing on December 19, 2018:

Assembly Bill 617

Assembly Bill 617 (AB 617) directs the state, in consultation with local air districts, to select communities that have a high cumulative exposure burden to air pollution. Once selected, these communities will work with local air districts on community emission reduction programs and/or air quality monitoring campaigns. The Air District is implementing these AB 617 efforts through the Community Health Protection Program.

The bill also requires expedited implementation of Best Available Retrofit Control Technology, or BARCT, at industrial Cap-and-Trade facilities.

AB 617 Expedited BARCT Implementation Schedule

AB 617 requires air districts to review the emissions control technology installed on pollution sources located at industrial facilities subject to the Cap-and-Trade program. The Air District has identified 19 of these industrial facilities in the Bay Area, encompassing over 1,800 sources.

To address facilities that do not have BARCT in place, each air district must adopt an Expedited BARCT Implementation Schedule before the end of 2018. The Air District has identified source categories for which BARCT is not in place and has created a list of six rule development projects to consider for implementation that will address emissions of PM, NOx, ROG, and SO2.

The Air District accepted public comments on the proposed Expedited BARCT Implementation Schedule, Staff Report, and CEQA Draft Environmental Impact Report (EIR): 

Staff presented the final proposed documents for the Expedited BARCT Implementation Schedule and CEQA analysis to the Air District Board of Directors for consideration at a public hearing on December 19, 2018.
