Rules 9-4 and 9-6 Building Appliances

Learn about the Air District's process for amending to Regulation 9, Rules 4 and 6 to reduce emissions of nitrogen oxides from residential and commercial furnaces and water heaters in buildings in the Bay Area.

Air District staff is currently evaluating potential amendments to two rules: Rule 9-4: Nitrogen Oxides from Fan Type Residential Central Furnaces and Rule 9-6: Nitrogen Oxides Emissions from Natural Gas-Fired Boilers and Water Heaters. These rules govern point of sale emission standards for small, typically residential and commercial, water and space heating systems.

The Air District is currently convening a Building Appliance Stakeholder Working Group to solicit stakeholder input in the development of regulatory amendments to further reduce emissions from commercial and residential space and water heating. The Air District is seeking both technical feedback as well as input on appropriate measures to ensure the rulemaking is equitable in process and outcomes through this workgroup.  Initial outcomes from this workgroup and first draft language of regulatory amendments will be presented and discussed at a public workshop on Thursday, October 7, 2021 from 6-8 PM and the Stationary Source and Climate Impacts Committee meeting on Monday, October 18, 2021 at 9AM. The Air District has released a Workshop Notice as well as a Workshop Report and draft rule amendment language:

Following the workshop and the close of the public comment period, staff will assess the need for changes to the draft rule amendments, with the goal of bringing the proposed final amendments to the Air District’s Board of Directors for their consideration in 2022.
