Amendments to Regulation 2, Rule 1 (Permits – General Requirements) and Regulation 2, Rule 5 (Permits – New Source Review of Toxic Air Contaminants) were adopted by the Air District Board of Directors at a public hearing on December 15, 2021. The adopted amendments are effective July 1, 2022:

The Air District has created an interactive mapping tool, the Overburdened Communities Map, which allows someone to determine if a project or facility is located within an overburdened community and subject to the more stringent health risk limits, public noticing requirements, and fees.

The Air District developed proposed amendments to specific rules within Regulation 2: Permits that pertain to new and modified sources of air pollution. These rules require permit applicants to apply for and demonstrate compliance with various emissions and exposure requirements to protect Bay Area air quality. In response to concerns regarding localized differences in air quality, the Air District has amended relevant portions of permitting rules to help ensure communities that are overburdened by poor air quality and health vulnerabilities are further protected from sources of air pollution. Air District staff has developed proposed amendments to two rules under the Permitting Regulation - Rules 2-1 and 2-5 - to minimize emissions to the environment and exposure to air pollutants by Bay Area residents.

The Air District released a Notice of Public Hearing, California Environmental Quality Act (CEQA) Initial Study and proposed Negative Declaration, CEQA Notice of Intent, proposed amendments to Rules 2-1 and 2-5, Final Staff Report, and other supporting documents in October 2021. On Wednesday, December 15, 2021, the Air District Board of Directors conducted a virtual public hearing and adopted amendments to Rules 2-1 and 2-5 and a Negative Declaration pursuant to CEQA.
