Today the Air District’s Board of Directors unanimously adopted one rule and two new rule amendments, part of a larger overall suite of new refinery-focused regulations that further tighten air pollution controls on petroleum refining activity in the Bay Area.

The Air District announced today that its independent Hearing Board, a quasi-judicial independent body authorized under state law, has approved an abatement order for Valero Refining Co. to cease unreported emissions at its Benicia oil refinery as safely and expeditiously as possible.

The Air District has fined Chemtrade West US LLC $160,000 for air quality violations at its sulfuric acid manufacturing plant in Richmond, which is connected to the Chevron Richmond refinery. Chemtrade supplies various chemical products to industry, including sulfuric acid, which is a byproduct of refining crude oil.

The Air District is inviting Bay Area residents to provide input on two new draft regulations. Regulation 11, Rule 18 would reduce health risk to local residents from toxic air contaminants emitted by facilities in the Bay Area, and Regulation 12, Rule 16 sets limits on facility-wide petroleum refining emissions.

On Wednesday, December 16, the Air District’s Board of Directors will consider three petroleum refining rules and amendments for adoption. The Air District originally planned to bring six rules for consideration, but due to the large number of public comments received, extra time is required to consider changes to the three remaining rules.

The Air District announced today it has reached two separate agreements with Chevron and Martinez Refining Company resulting in an end to the litigation against the agency over its groundbreaking Regulation 6, Rule 5, major emissions reductions from both refineries, unprecedented penalties and other payments of up to $138 million, and a Richmond-area Community Air Quality Fund, among other benefits. The Air District estimates that the emission reductions achieved by the rule will result in tens of millions of dollars per year in health benefits by reducing early deaths and other health impacts of exposure to particulate matter.
