Regulation 3: Fees - 2025 Amendment (Proposed)

Learn about the Air District's development process for amendments to Regulation 3, which would increase fee revenue to help recover a greater share of the costs incurred by the Air District in implementing and enforcing regulatory programs.

Amendments to Regulation 3: Fees include revisions to the Air District's fees & fee schedules and other regulatory language. If adopted, these amendments would be effective for the Air District’s Fiscal Year Ending (FYE) 2025, which begins on July 1, 2025.  

There are additional changes to the proposed rule from the version posted on February 20: 1) References to the ‘District’ were changed to ‘Air District’; 2) In Section 209, the gross annual income amount was increased from $750,000 to $1,500,000; 3) In Section 304, duplicative language was deleted; 4) In Section 320, obsolete language was removed; and 5) In Schedule B, the outdated reference to ‘the State Department of Health Services’ was changed to ‘the State Office of Environmental Health Hazard Assessment (OEHHA)’.

Under Agenda Item 6: Proposed Fiscal Year 2025-2026 Budget and Fee Regulation Amendments, starting with Slide 37, the proposed amendments were presented and discussed at the Finance & Administration Committee on March 19, 2025.  On May 7, 2025, there will be public hearing to receive testimony on the proposed amendments. On June 4, 2025, the Board of Directors will consider adopting the Regulation 3 amendments excluding amendments to Schedules S and V, which would become effective July 1, 2025.  On July 2, 2025, the Board of Directors will consider adopting the Regulation 3 amendments to Schedules S and V, which would become effective upon adoption.  Please check the main Air District website for meeting details about 72 hours prior to the meeting dates.  Public comment on the proposed draft amendments and associated documents will be accepted through May 16, 2025.  Written and/or email comments may be submitted to:
