Notifying Permit Applicants of a Regulatory Requirement to Use BACT for Emergency Backup Engines greater than or equal to 1000 BHP
The Air District is notifying permit applicants of achieved-in-practice BACT for large emergency backup engines. Who needs a permit?

Owners/operators of engines larger than 50 brake horsepower (bhp) are required to get Air District permits.

Items to be included in application

View the Air District's Form Guidance for information about completing Forms P-101B, ICE, and HRA.

For new engines and engines brought on site after September 1, 2001:

  • Application Form P-101B
  • Form ICE
  • Form HRA (one per engine, diesel engines only)
  • Manufacturer specifications including:
    • fuel consumption
    • rated horsepower output
    • emission rates for NOx, CO, hydrocarbons (NMHC), and particulates (PM10)
  • For engines with capacity of 700 bhp or less, the following fees are generally applicable for application processing:
    • $2,658 per diesel engine
    • $1,458 per natural gas/LPG/propane engine
    • Applications including engines within 1,000 feet of a K-12 school and/or diesel engines located within an overburdened community must also provide a Public Notice Fee of $2,272 per application
    • Diesel engines located within an overburdened community must also provide an Overburdened Community Fee of $1,000 per application
    • Any additional fees will be invoiced
  • For engines greater than 700 bhp, fees will be invoiced

For existing engines brought on-site on or before May 17, 2000:

  • Application Form P-101B (one per site)
  • Form ICE (one per engine).
  • If available, manufacturer specifications including:
    • fuel consumption
    • rated horsepower output
    • emission rates for NOx, CO, hydrocarbons (NMHC), and particulates (PM10)
  • Fees will be invoiced

For existing engines brought on-site after May 17, 2000, and before September 1, 2001:

  • Application Form P-101B (one per site)
  • Form ICE(one per engine).
  • If available, manufacturer specifications including:
    • fuel consumption
    • rated horsepower output
    • emission rates for NOx, CO, hydrocarbons (NMHC), and particulates (PM10)
  • Form HRA (one per engine, diesel engines only)
  • Fees will be invoiced

The application fees include a filing fee, an initial fee, and a health risk screening fee. Additional application fees may be included for engines installed without an Air District Authority to Construct and for engines operating without an Air District Permit to Operate. Please refer to Regulation 3, Fees. The filing fee is specified in section 3-302 of Regulation 3. The initial, risk screening, permit to operate, and toxic surcharge fees are specified in Schedule B of Regulation 3.

 For engines installed within 1,000 feet of a school site, California law requires that the Air District notify the public. To comply with this requirement, the Air District distributes or mails a Public Notice. You will be invoiced for a minimum additional fee of $2,272 to process the Public Notice. If the Air District's costs of preparing and distributing the Public Notice should exceed this amount, you will be sent a separate invoice with the additional fees due to cover these costs. If the Public Notice fees paid exceed the Air District’s costs, the Air District will refund you the difference.
