Boiler Stipulated Order of Abatement Program

Owners or operators of non-compliant small boilers that are rated between 2 and 10 million BTU/hour may be eligible for the Small Boiler Stipulated Order for Abatement Program for additional time to install or retrofit boilers to meet the applicable Regulation 9, Rule 7, emission limits.

Boiler Stipulated Order of Abatement Program

Owners/operators of a facility with small boiler(s) that has a rated input between 2 and 10 million BTU/hour may be eligible for the Boiler Stipulated Order for Abatement Program that allows the owner/operator time to install or retrofit boilers to meet the applicable Regulation 9, Rule 7, emission limits.

You may be eligible if:

  • The maximum rated input heat of each of your boiler is greater than 2 MM BTU/hr and less than 10 MM BTU/hr;
  • Each of your boiler(s) is fired using only natural gas, propane, or butane;
  • You do not have any equipment, other than a backup diesel generator, that would need an Air District permit to operate; and
  • You have registered each of your boiler(s) with the Air District.

The Air District issues permits for the operation of most types of stationary equipment that emits air pollution, including to owners of small facilities such as apartment and office buildings, schools, and small businesses like gas stations. Examples of such equipment that are common at small facilities include backup diesel generators, boilers with a maximum heat rating of 10 MM BTU/hr and above, and gasoline tanks and pumps. If your facility has any equipment, other than a backup diesel generator, subject to Air District permitting requirements, you are not eligible for the Stipulated Order for Abatement Program.

Air District Inspectors may conduct an inspection at your facility to verify that your boiler meets the program eligibility criteria.

Registration Requirement: Owners/operators of boilers with a rated heat input greater than 2 and less than 10 MM BTU/hr must register the boilers with the Air District and pay the required registration fee. You need not register these boilers if they have an Air District Permit to Operate. To register your boiler, use the Small Boiler Registration form which can be found at www.baaqmd.gov/registration or use the Air District’s online permitting system.
